ADMINISTRATIVE CAREER AND POWER OF PERSONNEL OF FISCAL CONTROL BODIES

We analyze the current situation of the administrative career before the power in matters of personnel of the Venezuelan fiscal control bodies from the personnel statute of the general comptroller of the Bolivarian Republic of Venezuela. It is based on the hypothesis according to which, this statute, by instituting that the positions of the general comptroller of the republic are trustworthy, consequently, of free appointment and removal, contravenes the principles that guarantee stability as a fundamental characteristic of the administration regime. public. This descriptive investigation, through the analysis of documentary content of a doctrinal, legal, and jurisprudential nature, allows us to conclude that the aforementioned personnel statute violates the stability of position and eliminates the category of career civil servant in the bodies that make up the national fiscal control system, unset the administrative career regime.
This administrative act is contrary to the Constitution of the Republic and the law, is not in accordance with the public interest and causes injury to all persons who aspire to or hold a career position in the fiscal control bodies, which is why it is established considering the of law, subject to nullity for illegality and unconstitutionality.
